These Terms of Service (“Terms”) govern access to https://desktop-leafpoint.click (the “Site”) and the programming consulting services offered by Desktop Leafpoint (“we,” “us”), including embedded software delivery and firmware team advisory. By using the Site or commissioning work, you agree to these Terms.

1. Acceptance

If you do not agree, do not use the Site or request engagements. Requests submitted through the contact form constitute an inquiry, not an automatic contract. A binding engagement begins only when both parties accept a written scope or statement of work.

2. Services described

The Site describes informational offerings such as delivery partnerships, advisory retainers, architecture assessments, and bring-up support. Descriptions, rates, and timelines are guidance only until confirmed in writing. We do not sell software products, subscriptions, or checkout-based purchases on this Site.

3. Intellectual property

Site content — text, styling, and graphics we create — is owned by Desktop Leafpoint or used under license. You may not copy substantial portions for commercial use without permission. Firmware, documentation, and tools created under an engagement are governed by the statement of work; unless otherwise agreed, client-owned product code remains the client’s, and our pre-existing methods and templates remain ours.

4. Acceptable use

You may not misuse the Site, attempt unauthorized access to systems, submit unlawful content, or use contact channels to spam. We may refuse or terminate inquiries that appear abusive or outside our competence.

5. No warranty on Site content

The Site is provided “as is.” We strive for accuracy but do not warrant that all technical examples or rate figures remain current. Engagement outcomes depend on client constraints, hardware availability, and decisions outside our control.

6. Liability

To the fullest extent permitted by law, Desktop Leafpoint is not liable for indirect, incidental, or consequential damages arising from Site use. For paid engagements, liability is limited as stated in the applicable statement of work; if silent, liability is limited to fees paid for the specific engagement giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Thai law.

7. Governing law

These Terms are governed by the laws of Thailand. Courts in Thailand shall have jurisdiction over disputes arising from Site use or engagements, without prejudice to mandatory consumer protections that may apply.

8. Changes

We may update these Terms by posting a revised version on this page with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
